INSTRUCTIONS TO THE VOTER
     1. This declaration of identity relates to the ballot papers for the Scottish Parliament election only. You must sign this declaration of identity in the presence of a person known to you. You are required to do this even if you have already signed a similar declaration of identity in respect of another election to be held on the same day. That person should then sign this declaration as a witness, adding his or her name and address. Without this the declaration will be invalid.

     2. You have 2 ballot papers.

     3. You may vote once only on each ballot paper. Mark your choice with a cross (x). Put no other mark on the ballot paper, or your vote may not be counted. Do this secretly. If you cannot vote without assistance, the person assisting you must not disclose how you have voted.

     4. The papers coloured [insert colours] are used for the Scottish Parliament election. The ballot paper coloured [insert colour] is used for the local government election. There is one small envelope marked "A" in which the Scottish Parliament election ballot papers are to be inserted and another envelope marked "A" in which the ballot paper for the local government election is to be inserted. Accompanying each envelope marked "A" is a declaration of identity and covering envelope (the larger envelope marked "B"). The covering envelope and declaration of a identity for a particular ballot paper are those which refer to the colour of that ballot paper. It is important that you use the correct envelopes and declaration of identity, otherwise your vote may not be counted. You may find it helpful to sort the documents into separate sets, consisting of ballot papers, ballot paper envelopes, declarations of identity and covering envelopes. Then proceed as follows  - 

    (a) Place the ballot papers in the correct smaller envelopes and seal them;

    (b) Put those envelopes, together with the correct declaration of identity, in the correct covering envelopes and seal them;

    (c) Return the covering envelopes without delay. The ballot papers, in order to be counted, must be received by the returning officer not later than the close of the poll.

     5. If you receive more than one ballot paper of the same colour, remember that it is illegal to vote more than once on the same type of ballot paper (otherwise than as proxy) at any election.

     6. At this election you cannot vote in person at a polling station, even if you receive an official poll card.

     7. If you inadvertently spoil any Scottish Parliament postal ballot paper, you can apply to the returning officer for a new one. If you do this you MUST RETURN ALL OF THE POSTAL BALLOT PAPERS YOU HAVE RECEIVED in relation to the Scottish Parliament election, including the spoilt ballot paper. In addition, in your application for fresh postal ballot papers you MUST RETURN in your own envelope, the declaration of identity and the envelopes marked "A" and "B" relating to the Scottish Parliament election. Remember that there is little time available if fresh postal ballot papers are to be issued and counted.

     2. At the same time as this statement is sent to the Sheriff Clerk a copy must be sent to the Secretary of State for Scotland.

     3. Column C relates to the postal ballot papers issued for the election for return of a constituency member in the above-mentioned constituency.

     4. Column D relates to the postal ballot papers issued for the election for return of a regional member in the above-mentioned constituency.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order makes provision as to the conduct of elections and return of members to the Scottish Parliament ("the Parliament") which was established by the Scotland Act 1998.

Part I of the Order contains general provisions concerning the commencement, citation and interpretation of the Order.

Part II of the Order makes provision about the franchise for the Parliament and its exercise.

Part III of the Order makes provision concerning election campaigns at Scottish parliamentary elections.

Part IV of the Order (with Schedule 6) makes provision in connection with legal proceedings.

Part V of the Order makes miscellaneous and supplemental provision, for example, in relation to the filling of certain vacancies.

Schedule 1 makes provision in respect of electors lists and registers.

Schedule 2 contains the Scottish Parliamentary Election Rules.

Schedule 3 makes provision concerning absent voting.

Schedule 4 makes provision about the issue and receipt of postal ballot papers.

Schedule 5 makes provision concerning the combination of polls.
