LOCAL GOVERNMENT PENSION SCHEME (HER MAJESTYS CHIEF INSPECTOR OF SCHOOLS IN ENGLAND) (TRANSFERS) REGULATIONS 2001
I enclose regulations, which the Secretary of State has made under powers contained in sections 7 and 12 of the Superannuation Act 1972. The regulations introduce free standing provisions covering the calculation of transfers out of the LGPS and come into force on 1 September 2001
Under the Care Standards Act 2000 responsibility for approving, monitoring and policing child care arrangements will transfer from local authority social services departments in England to OFSTED. The transfer of the function and the related staff takes place on 1 September 2001. Any staff transferring to OFSTED will have the option of moving completely to civil service terms and conditions, including access to the Principal Civil Service Pension Scheme (PCSPS), or retaining local government terms and conditions, with ongoing access to the LGPS
In order to ensure equitable transfer credits in the new scheme and fair payment in respect of liabilities being transferred these regulations :-
Define the group of individuals transferring either to the PCSPS or within the LGPS; and
In the Schedule to these regulations sets out the appropriate uplift to be applied to normal cash equivalent transfer value calculations.
Separate arrangements, effective from 1 April 2002, will apply in Wales where the responsibility is being transferred to the National Assembly for Wales.
